English: An Armenian woman from Artvin in national costume, photographed by Sergey Prokudin-Gorsky between 1909 and 1912. The scan was made using a three-color separation process. This is a digitally restored photograph, which was altered only to remove dark scratches, color-separation spots, color-separation color bleed, and writing. Contrast and colors were not enhanced nor was the image sharpened. The image was cropped from the full-frame negative to remove the frame. The image was not stretched or warped as it was already straight during the scanning process. Restoration work was performed on the original TIFF file downloaded from the U.S. Library of Congress Prints & Photographs Online Catalog.

This work was published on territory of the Russian Empire (Russian Republic) except for territories of the Grand Duchy of Finland and Congress Poland before 7 November 1917 and wasn't re-published for 30 days following initial publications on the territory of Soviet Russia or any other countries.

The Russian Federation (early Soviet Russia, RSFSR) is the historical heir but not legal successor of the Russian Empire, and the Russian Empire was not party to the Berne Convention (it was not country of Union for the protection of the rights of authors in their literary and artistic works), so according to article 5 of the Convention this work has no country of origin except:

  • in the case of cinematographic work the maker of which has his headquarters or his habitual residence in a country of the Union, the country of origin shall be that country,
  • in the case of of architecture erected in a country of the Union or other artistic works incorporated in a building or other structure located in a country of the Union, the country of origin shall be that country,
  • in the case of other works if the author is a national of a country of the Union¹, the country of origin shall be that country.

¹ - Author who is not a national of a country of the Union but who has his habitual residence in a country of the Union, be assimilated to national of that country.

The exclusive rights to this work do not extend on territory of the Russian Federation according to article 1256 of the Civil Code of the Russian Federation (details), because this work does not meet the requirements on the territory of publication, on the author's nationality, and on obligations for international treaties.

This is one of the earliest color photographs in existence and was originally taken by Sergei Mikhailovich Prokudin-Gorskii as part of his work to document the Russian Empire. It was taken using three black-and-white exposures, with red, yellow and blue filters respectively, long before color photographic printing existed. The three resulting images were projected using color filters to create a color projection.

More recently, the Library of Congress has scanned Prokudin-Gorskii's work and contracted with other firms to produce high-resolution color images from the black and white scans. See the The Empire that was Russia exhibit.

This file is in the public domain; it was taken from the Library of Congress website. The Library of Congress published the following "Rights and Restrictions Information" (http://lcweb.loc.gov/rr/print/res/237_prok.html):

Publication and other forms of distribution: Permitted. There are no known restrictions on the use of these images. The issue of copyright was not addressed during the purchase of the collection from Prokudin-Gorskii's heirs in France in 1948. French law is unclear as to whether the heirs own any rights. However, they have expressed concern about "commercial use" and alteration or manipulation of the images.
